A school board trustee accused of embezzling $125,000 from two Lake Tahoe parents clubs is seeking appointment of a public defender.

Erinn Coleen Miller appeared in Tahoe Township Justice Court in custody on Tuesday afternoon, not long after it was announced she’d been arrested on two felony counts involving thefts from the Zephyr Cove Parents Club and the Warrior Boosters Club.

Bail was set at $25,000 bondable or $3,750 cash for Miller, 46, under the condition she surrender her passport, wear a GPS locating device and be under the supervision of the Department of Alternative Sentencing.

Senior Judge Richard Glasson also granted a motion from the state ordering Miller not to act as a fiduciary without a written waiver being executed by a client indicating they know about the case. Miller is also required to inform her current clientele about the status of the case.

Glasson said Tahoe Township Justice of the Peace Michael Johnson had voluntarily recused himself because he has children at the schools.

Whether Miller qualifies for an appointed attorney will be determined by Glasson unless the parties agree for Johnson to hear the case. Glasson ordered the case continued to Sept. 15, when he would be back on the bench.

Douglas County Indigent Defense Coordinator Brian Filter appeared on behalf of Miller on Tuesday and asked for her release on her own recognizance.

“She is a resident of Zephyr Cove … and has lived in the same home for 10 years,” he said. “She is a self-employed wife and mother of three, who poses zero flight risk. The only risk she poses is financial and should be covered by the restriction on her.”

Filter said Miller had no criminal history.
